General provisions

These terms and conditions are valid exclusively between AZARY SRL di AVOUMADO FOLY, with registered office at Via Leonardo da Vinci n. 43,35018 San Martino di Lupari (Pd), REA PD-465906, VAT number 05416380284, hereinafter referred to as ‘AZARY SRL’ and any person who makes online purchases on the website shop.folyexport.com, hereinafter referred to as ‘CUSTOMER’. These terms and conditions are subject to change and the date of publication on the website is equivalent to the date of entry into force.

These terms and conditions govern purchases made on the website shop.folyexport.com.

By accessing the website shop.folyexport.com, CUSTOMERS agree to accept all the terms and conditions contained in this statement.

These General Terms and Conditions of Purchase do not regulate the provision of services or the sale of products by parties other than AZARY SRL that are present on the website shop.folyexport.com through links, banners or other hypertext links.

Sales prices

Unless otherwise stated in writing, all Product prices indicated on the website are inclusive of VAT and expressed in euros. The validity of the prices indicated is always and only that indicated on the website at the time the Order is placed via the Internet. Product prices are subject to change without notice. Therefore, please check the final sale price before placing your Order.

All Products are shipped directly from Italy. Unless otherwise specified, the prices of the Products do not include any costs related to customs duties and related taxes, which cannot be calculated in advance, if the shipment is to countries outside the EU or to countries where current legislation provides for import charges. In this case, the existence of any additional costs mentioned above will be clearly mentioned when placing and reviewing the Order, it being understood that the precise amount of these costs will be communicated by the Carrier to the Customer at the time of delivery of the products.

Order management

The products are offered for sale in accordance with the terms and conditions set out in the contract and published on the Website at the time of ordering. The purchase of products implies full and unreserved acceptance of these general terms and conditions of sale, which shall remain valid and effective until they are amended and/or supplemented by AZARY SRL. Any amendments and/or additions shall be effective from the date on which they are published on the Website and shall apply to sales made from that date onwards.

Any order confirmation signed by clicking on the validation button or confirmed by email constitutes an irrevocable commitment on the part of the customer, which can only be called into question in the cases provided for in this contract.

The customer will receive an email notification of receipt containing all the details of the order. However, the order shall only be considered valid and binding upon receipt of payment by AZARY SRL, which undertakes to send an email confirming receipt of payment and acceptance of the order to the email address provided by the customer.

AZARY SRL cannot be held responsible for delivery errors due to inaccuracies or incompleteness in the customer's purchase order.

In the case of payment by bank transfer, AZARY SRL will hold the CUSTOMER's order until payment has been recorded in its bank account with the following bank details:

Shipping and shipping costs

Order processing and shipping date

CUSTOMER orders are processed by AZARY SRL and delivered to the carrier within 5 working days, subject to confirmation of the availability of the goods and bank verification of payment. In the case of a product manufactured specifically for the customer, the order will be entrusted to the carrier once the product has been manufactured.

Orders placed on Saturdays, Sundays or other public holidays will be processed on the first working day following the order.

Home delivery is carried out by transport companies and requires the recipient to be available and to have the appropriate means for unloading the goods. If the courier is unable to complete the delivery of a shipment due to the recipient being unavailable or the lack of suitable means for unloading, the CUSTOMER agrees to pay AZARY SRL any expenses incurred in order to redeliver, forward or return the shipment.

For international shipments (non-EU countries), customs and clearance costs incurred by the courier shall be borne by the CUSTOMER.

Upon arrival of the goods, CUSTOMERS are requested to carefully inspect the package before signing for delivery of the shipment. The CUSTOMER who places an order establishes a commercial relationship with AZARY SRL and therefore undertakes to accept delivery of the goods purchased. If, for any reason, the CUSTOMER refuses delivery of the shipment or requests its return to the sender, any shipping costs charged to AZARY SRL will be deducted from any refund due to the CUSTOMER.

The price of the product does not include transport costs, the amount of which can be found by adding the product to the shopping cart and registering, or by sending an email to info@folyexport.com.

Transport costs vary according to the quantity and destination of the goods. The costs are clearly indicated at the checkout stage and in the ‘Shipping Costs’ section. Transport costs are entirely borne by the CUSTOMER.

Right of Return

The CUSTOMER has the right to withdraw from the contract concluded with AZARY SRL by returning the purchased products within ten (10) working days from the date of receipt, as required by law. The shipping costs for the return are borne by the CUSTOMER, and the products must be returned in their original, undamaged packaging. The products must not have been damaged.

As provided for by Legislative Decree 21/2014, the supply of custom-made or personalised goods, goods made to measure or lists of products selected and ordered specifically for the consumer is excluded from the right of withdrawal on online purchases.

Specifically, if an order has been processed for which a product has been specially manufactured for the customer, the right of return cannot be applied.

The right of withdrawal is therefore excluded by law for products created specifically for the customer, such as skirting boards, steps, L-shaped elements and special workmanship in general, products whose manufacture has been ordered solely for that particular consumer.

Furthermore, the right of withdrawal cannot be exercised by the Customer:

in the absence (or obvious damage) of the original packaging;
in the absence of integral elements of the product;
for damage to the product caused by the Customer.
for sealed goods that cannot be returned for hygiene reasons;
for services already performed.

Website Regulations

To place orders on AZARY SRL, CUSTOMERS must:

Be at least 18 years of age;
Meet the requirements necessary to enter into legally binding contracts;
Have a valid email address;
Guarantee that they are consumers in accordance with Article 3 of the Consumer Code.

Availability of Items

AZARY SRL reserves the right to reconfirm the availability of items purchased online. If for any reason the order cannot be fulfilled as requested, the CUSTOMER will be notified promptly.

Reservation of Order Refusal

AZARY SRL reserves the right to refuse orders or refuse to provide services to anyone at any time.

Disclaimer

AZARY SRL publishes information on its website in order to provide a service to its CUSTOMERS, but declines all responsibility for any technical or factual inaccuracies and/or typographical errors, which will be corrected immediately upon notification.

AZARY SRL declines all responsibility for the possibility that, due to a particular configuration of the computer used by the CUSTOMER, the images and in particular the colours of the products displayed on the website may differ slightly from the original ones.

AZARY SRL guarantees that its website is protected in accordance with international standards for the Internet. When used correctly, the User is protected from the risk of viruses. AZARY SRL declines all responsibility for any malfunctions related to the deactivation of cookies in the user's browser.

AZARY SRL reserves the right to amend/review the terms and conditions contained in this legal notice by updating it whenever it deems appropriate, without any obligation to give prior notice.

The CUSTOMER is required to comply with the terms contained in this legal notice, periodically checking for any updates, changes and corrections.

Privacy

AZARY SRL, as the operator of the activities available on the shop.folyexport.com website, reserves the right to use the personal data voluntarily provided by CUSTOMERS in compliance with current regulations (Articles 13 et seq. of Legislative Decree 196/2003).

CUSTOMERS are therefore invited to visit this section periodically to keep up to date with changes relating to amendments to current legislation.

AZARY SRL guarantees CUSTOMERS that the processing of personal data will be reserved for uses strictly connected and related to the provision of its services and the fulfilment of orders.

The data voluntarily provided by CUSTOMERS will not be communicated or disclosed to third parties under any circumstances.

Personal data will be processed by AZARY SRL using both paper and electronic means, in compliance with current security regulations, for the purposes that will be specified from time to time.

AZARY SRL informs CUSTOMERS that they may exercise their rights under Article 7 of Legislative Decree 196/2003, the essential part of which is reproduced below. CUSTOMERS have the right to request the following information from AZARY SRL:

confirmation of the existence or otherwise of personal data concerning them
clear communication of the data and its origin
the reason and purpose of its existence and use

The request for the above information may be renewed whenever deemed necessary by the CUSTOMER.
