INFORMATION ON THE PROCESSING OF PERSONAL DATA

1. Data controller

Pursuant to Articles 13.1 and 14.1 of GDPR 679-2016, known as the ‘General Data Protection Regulation’, we hereby inform you that the processing of personal data communicated during the supply of goods/services, aimed solely at fulfilling contractual obligations and complying with your specific requests, as well as complying with regulatory obligations, in particular accounting and tax obligations, will be carried out by:

the company AZARY SRL, with registered office in San Martino di Lupari (PD), via Leonardo da Vinci n. 43, VAT number and tax code 05416380284, using procedures, including computerised procedures, in the manner and within the limits necessary to pursue the aforementioned purposes.

2. Types of data collected and purposes of processing

We collect and process the following personal data for the purposes indicated:

A) Data provided voluntarily by the user

· Identification and contact details: first name, surname, e-mail address, telephone number, shipping and billing address.

· Tax data: tax code, VAT number (if required), recipient code or certified email address for electronic invoicing.

· Payment data: information necessary to process the payment (card number, circuit, expiry date), processed through secure third-party gateways.

Purpose:

· Order management and fulfilment (legal basis: performance of the contract).

· Issuing invoices and fulfilling tax and accounting obligations (legal basis: legal obligation).

· Customer service and management of complaints, returns and refunds (legal basis: performance of the contract).

B) Data collected automatically

Browsing data: IP address, browser type, pages visited, time spent on the site, geographical origin (through technical cookies and analytics).

Cookies and tracking technologies: to improve your experience and analyse the performance of the website.

C) Marketing and newsletters (optional consent)

With your explicit consent, we may use your email address and telephone number to:

  • Send commercial communications, promotional offers, news about products and services (bathroom furniture, sanitary ware, tiles).
  • Profiling for personalised offers based on your purchases and preferences.

Legal basis: consent (Art. 6.1.a GDPR). You may withdraw your consent at any time.

3. Methods of processing

The data provided will be processed:

· in compliance with the above-mentioned regulation,

· in accordance with the obligations of confidentiality and lawfulness

· for the time strictly necessary for which it was collected,

· in compliance with current tax and civil law regulations

4. Recipients and communication of data

The data will not be disclosed. Your data may also be communicated to the following subjects or categories of subjects for strictly professional reasons and/or for the purpose of providing our service in the best possible way, always within the limits strictly relevant to the purposes indicated:

· subjects to whom communication is required by law.

· Credit and/or financial institutions.

· Our external collaborators, identified and designated by us.

· Accountants and consultants for accounting or tax purposes.

Consent is not required when the processing:

a) is necessary to fulfil an obligation under the law, a regulation or Community legislation;

b) is necessary to perform obligations arising from a contract to which the data subject is party or to fulfil, prior to the conclusion of the contract, specific requests from the data subject;

c) concerns data from public registers, lists, deeds or documents that are available to anyone, without prejudice to the limits and procedures established by laws, regulations or Community legislation for the disclosure and publicity of data.

5. Rights of the data subject

The Regulation recognises the rights of the data subject under Articles 15, 16, 17, 18, 19, 20, 21 and 22 of GDPR 679/2016.

In summary, the Regulation allows the data subject to request from AVOUMADO FOLY, as the legal representative of Azary srl and data controller, at any time:

· access to their personal data (and/or a copy of such personal data), as well as further information on the processing of such data;

· the rectification or updating of their personal data;

· the deletion of their personal data from AVOUMADO FOLY's databases;

· the restriction of the processing of their personal data by AVOUMADO FOLY;

· data portability, i.e. to obtain a copy of their personal data provided to AVOUMADO FOLY in a structured, commonly used and machine-readable format, or to request its transmission to another Data Controller;

· opposition to the processing of their personal data;

· withdrawal of their consent for the intended purposes.

AVOUMADO FOLY, legal representative of Azary srl, will provide the Data Subject with information relating to one or more of the actions taken as listed above without undue delay and, in any case, no later than one month after the request. This period may be extended by two months, taking into account the complexity and number of requests, with the Data Subject being informed of this extension and the reasons for the delay, to be provided within one month of receipt of the request.

The Data Subject may exercise their rights by post or e-mail by contacting Azary srl, via Leonardo da Vinci n. 43, 35018 San Martino di Lupari (PD).

The data subject also has the right to lodge a complaint with the competent Supervisory Authority (for Italy, this is the Garante Privacy, http://www.garanteprivacy.it), if they believe that the processing of their personal data is contrary to the legislation in force.

6. Terms of payment

Credit/debit card payments

For credit or debit card payments, we use one or more external payment services (e.g. [gateway name: Stripe, Nexi, etc.]), which operate on a secure connection and comply with international security standards for the protection of payment card data (e.g. PCI-DSS). Card details (number, cardholder name, expiry date, security code) are entered directly on the payment service provider's page or in a dedicated iframe managed by the provider and are not transmitted or stored in any way on our servers.

We only receive the outcome of the transaction and some limited, non-sensitive information (e.g. card type, last digits masked, transaction ID) necessary to manage the order, any refunds and fraud prevention.

Payments via PayPal

If you choose to pay with PayPal, you will be redirected to the PayPal website, where you can complete the payment using your account or a payment card accepted by PayPal. In this case, PayPal processes your personal data as an independent data controller, in accordance with its privacy policy, which can be consulted on the website www.paypal.com.

Again, we do not have access to your full card or PayPal account details: we only receive from PayPal the information strictly necessary to confirm the payment, manage the order and any refunds or disputes (e.g. transaction ID, payment status).

Payments by bank transfer

In the case of payment by bank transfer, the personal data necessary to execute the payment (e.g. account holder, bank and transfer details) are processed by the credit institution through which you make the transaction, as an independent data controller.

We receive information about the payment (amount, reason, value date, any payer details shown on the bank statement) for the sole purpose of verifying the credit, associating the payment with the order and fulfilling accounting and tax obligations.

7. Cookies

A cookie is a short text sent to your browser by a website you visit. It allows the site to store information about your visit, such as your preferred language and other settings. This can make your next visit easier and increase the usefulness of the site for you. Cookies play an important role. Without them, using the web would be a much more frustrating experience.
